Participation agreement, waiver & release

How this works. Every athlete — including trial-class visitors — needs this agreement signed by a parent or legal guardian before stepping on the carpet. Enrolled families sign it electronically in the parent portal; for a trial class you can sign it on arrival. Read it carefully: it affects your legal rights.

2. Acknowledgment of risk

I understand that rhythmic gymnastics, including stretching, flexibility and strength training, ballet, apparatus work (rope, hoop, ball, clubs, ribbon), leaps, balances, rotations and acrobatic elements, involves inherent risks of injury — from minor bruises and strains to serious injuries such as fractures, joint or spinal injury, and, in rare cases, permanent disability or death. These risks exist even when the activity is properly supervised and equipment is properly used. I have had the opportunity to ask questions and I voluntarily allow my child to participate with full knowledge of these risks.

3. Assumption of risk and release

On behalf of myself, my child and our heirs, I assume all risks of participation and release, waive and discharge Flawless Gymnastics, LLC, its owners, coaches, employees, volunteers, and the owners of any facility used for training or events (the "Released Parties") from all claims, demands and liability for injury, illness, death, loss or property damage arising from my child's participation, including claims arising from the ordinary negligence of the Released Parties, to the fullest extent permitted by California law. This release does not extend to gross negligence, willful misconduct or fraud.

4. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claim brought by or on behalf of my child, or by a third party, resulting from my child's participation, including reasonable attorney's fees.

5. Medical authorization

In an emergency, if I cannot be reached promptly, I authorize the coaches to obtain emergency medical treatment for my child, including transport by ambulance, and I accept financial responsibility for such treatment. Known allergies, conditions or medications the coaches should be aware of: ______________________________________________. 6. Conduct, SafeSport and supervision

Flawless Gymnastics, LLC is a USA Gymnastics member club and follows the U.S. Center for SafeSport Code and USA Gymnastics Safe Sport Policy, including limits on one-on-one contact, electronic communication and locker-room practices.
Parents are welcome to observe from designated areas. Children must be dropped off and picked up on time; the club is not responsible for supervision outside scheduled class time.
Athletes are expected to follow coach instructions, arrive prepared (hair in a bun, training attire, required equipment) and treat teammates with respect. The club may dismiss an athlete for conduct that endangers safety.

7. Photo and video release

☐ I consent to Flawless Gymnastics, LLC photographing and recording my child during classes, events and competitions, and to using that material — without compensation and without identifying my child by full name — on the club's website, social media and printed materials.
☐ I do not consent to public use. (Coaching and internal record footage is still taken.)
Consent may be withdrawn at any time by email to rg@flawlessgymnasticsacademy.com.

8. Tuition and policies

Tuition is billed monthly through the parent portal. Missed classes are non-refundable; make-up classes are offered at the club's discretion. Thirty days' written notice is required to withdraw. Competition fees, USA Gymnastics membership, leotards and apparatus are the family's responsibility and are non-refundable once paid to third parties. Schedules may change; families will be notified in advance.

9. Governing law and severability

This agreement is governed by the laws of the State of California. Venue for any dispute is San Diego County. If any provision is found unenforceable, the remainder stays in effect. This agreement continues for the entire period my child participates, including future seasons, unless revoked in writing.

I HAVE READ THIS AGREEMENT, I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND I SIGN IT VOLUNTARILY.
